The Minor Possession Expungement Act

Too many good people can’t find work because of old nonviolent drug convictions. It’s unfair, especially when marijuana is now legal in most states. The Minor Possession Expungement Act I authored will automatically clear criminal records for individuals convicted of possessing small amounts of drugs, as long as there was no violence, intent to sell, or sex crime involved. This bill ensures no one will ever face jail time again for simple possession. Automatic Expungement

• Eligible non-violent drug possession convictions are automatically expunged without requiring petitions or court fees.

• Clears records for offenses that are now decriminalized or involve minor amounts.

Eligibility Requirements

• Applies to first-time and low-level drug possession offenses with no violent criminal history.

• Individuals must have completed any required sentences, probation, or diversion programs.

Expanded Diversion Programs

• Prioritizes treatment and rehabilitation over incarceration for substance abuse offenses.

• Provides access to counseling, job training, and support services.

• Successful completion of diversion programs leads to case dismissal and expungement.

Second Chance Opportunities

• Removes criminal record barriers that prevent access to employment, education, and housing.

• Ensures fair consideration for individuals who have completed their sentences and rehabilitation.

1. Expungement of Records:

This bill will ensure that any individual previously convicted of possessing small amounts of marijuana or other illegal drugs, with no ties to violent crime, dealing, or sex crimes, will have their records expunged and cleared.

2. No Jail Time for Simple Possession:

No one will face jail time for possessing small amounts of illegal drugs going forward, unless the offense is connected to dealing, violence, or sex crimes.

3. Legalization of Marijuana:

Marijuana will be made completely legal nationwide for both medical and recreational use for individuals 18 and older.

4. Confiscation Without Incarceration:

If someone is found with small amounts of drugs not linked to serious crimes, law enforcement may confiscate and dispose of the drugs but will not incarcerate the individual. They may also provide resources for drug education or diversion classes.

5. No Repeated Jail Time for Possession:

No matter how many times a person is caught with small amounts of drugs not connected to serious crimes, they will never face jail time solely for possession.

6. Existing Laws Still Apply:

All laws regarding DWI, DUI, or operating any vehicle under the influence remain fully in effect, as do laws regarding lewd conduct and public intoxication.
